I have been successful in trying and settlements of car accident victims in NYC.  One such result was the case Petrus Madito v  Farindun A. NORMUKHAMEDOV  and SINAI I, INC. ,  My client was injured when a truck carrying dialysis patients went over the double yellow line, while the driver was presumably texting. Mr. Madito suffered a displaced fracture fragment of the wrist , and three (3) herniated cervical discs and 1 lumbar herniated disc, which impinged on the spinal nerve roots. He was unable to work for approximately 3 years and was limited in returning to work as a taxi driver, due to prolonged sitting.  The client was scared to undergo a laminectomy a procedure to remove a herniated disc. The case was mediated where an offer of $80,00 was made.  At trial right before the verdict the offer was increased to $200,000. The jury returned a verdict of 1.4 million which was later reduced by the Court to $750,000.

 Over the years in 1994, I once had the highest non-surgical herniated disc case in NYS in the case of Louise Loadholt v Funaway Tours. In that case, my client was a passenger in an Atlantic City bus struck in the rear while on the shoulder of a highway by another bus. The insurance company lawyers blamed Ms. Loadholt's herniated disc on her weight. The jury disagreed and returned a verdict in the amount of $750,000.
