$1,400,000.00 Verdict Supreme  Bronx 2017  TOP 100 New York State Verdict , Supreme Court , Bronx County.

 Facts: Plaintiff a taxi driver, age 40 was operating a taxi and struck in a head on collision by a 2 -ton ambulette .  The police report, and non-  party testimony of a passenger n the van indicated that the driver of the ambulette was texting immediately before the impact and went over the double yellow line into plaintiffs lane .

Mr. Madito sustained the following injuries:   a right ulnar collateral ligament tear with surgical repair of thumb;  two non- surgical herniated disc in his cervical spine broad based disc bulge and left herniation at C5-C6; a lumbar disc bulge and a  T5-6 herniated disc.  The plaintiff could not perform his usual activities as a taxi driver for 3 years.

The  Jury's award was allocated as follows $300,00 for past pain and suffering;  $500,000 for future pain and suffering of 30 years; $100,000 for past medical expenses, and  $500,000 for future medical expenses.  Edward Lemmo Esq. was the lead trial attorney on the case along with Steve Halperin Esq.
